Insurance Coverage for PFAS Under Historical CGL, Modern Environmental and Other Insurance Policies

This program will address insurance coverage for the potential environmental impacts of PFAS, such as the costs of testing or remediation required by the government, as well as other potential non-environmental PFAS claims. Environmental coverage under two sorts of policies will be discussed: historical general liability policies and more modern environmental policies. The presenters will also review several hypotheticals to illustrate practical strategies to maximize insurance coverage for the mounting environmental costs associated with the suite of chemicals known as PFAS. As to non-environmental claims, the presenters will discuss the interplay between general liability policies and the rise in other PFAS-related claims (such as false advertising or misrepresentation claims), identifying instances where coverage may or may not be available, how coverage may be maximized, and strategies for addressing potentially recalcitrant insurers.
