Earlier this year, U.S. Attorney General Pam Bondi issued a policy directive limiting criminal enforcement of the Foreign Agents Registration Act (FARA), the federal law that requires organizations to register with the Department of Justice (DOJ) when engaged in certain activities on behalf of foreign partners. The announcement was a significant shift in DOJ priorities from recent years and left open many questions about civil enforcement priorities and the status of a pending rulemaking. Adding to the uncertainty, five states have enacted so-called baby FARA laws this year, intended to regulate foreign support of state-level activities. In this webinar, Venable partner Meredith McCoy and associate Justin Rusk will explore how this directive has impacted FARA enforcement to date, what changes have taken hold, what developments are—and are not—expected moving forward, and how those changes affect nonprofits.
