On September 3, 2026, the U.S. Department of the Treasury and the Internal Revenue Service (IRS) announced proposed regulations that could significantly affect independent schools and their federal tax-exempt status. If finalized, the proposed rules would prohibit tax-exempt independent schools from adopting, maintaining, or enforcing policies or practices that discriminate based on race, color, or national or ethnic origin.
In this webinar, Venable attorneys will discuss the proposed regulations and their potential impact on independent school operations, including admissions practices, financial aid and scholarships, donor-restricted funds, and diversity and inclusion programs. We will also examine practical steps schools should consider now as they review existing policies and practices and evaluate race-neutral approaches to advancing access and educational opportunity.
