Venable partner Hirsh Ament will speak on a panel, “The Supreme Court Has Spoken: Preparing for the Future of Activism,” at the Retail Alternatives and Closed-End Funds Conference in New York City on November 10. The Supreme Court handed down its decision in FS Credit Opportunities Corp. v. Saba Capital Master Fund, Ltd., deciding whether a private right of action exists to challenge closed-end fund bylaws. With that decision in hand, funds and boards should analyze existing defenses they had in place, which may vary, depending on their state of incorporation. This panel will break down the opinion and discuss its impact on existing bylaws and state regulatory measures.
Venable will be participating as a tabletop sponsor. For more information, please click here.
