Cristina Vessels and Ashleigh Allione will present “Developments and Trends in Charitable Fundraising Compliance” at the annual Nonprofit Legal, Finance, and Grants Conference on October 7, 2026.
In this session, we will cover recent legislative developments, enforcement actions, and industry trends affecting charitable fundraising. Session attendees will learn the compliance ins and outs of perennial favorites in cause-related marketing (such as customer donation programs and charitable sales promotions conducted by commercial co-venturers), as well as other highly regulated promotional fundraising structures (such as charitable raffles and sweepstakes). We will also cover what organizations need to know about charitable fundraising platform rules that come into play when they engage in or support online charitable fundraising. Finally, we will cover new legislation restricting certain foreign donors from making contributions (Florida SB 700), as well as recent enforcement matters that offer lessons learned for others operating in this space (for example, the recent inquiry by 21 states' attorneys general and charity regulators involving GoFundMe and its practices).
Key Takeaways
At the end of this session, participants should be able to:
- Properly identify and distinguish among the various charitable fundraising structures
- Understand the fundamental compliance considerations relevant to each unique promotional structure
- Review marketing materials and disclosures to comply with legal requirements and mitigate the risk of drawing undesired regulatory scrutiny for a campaign
- Identify actionable steps to review their own organization's practices in order to minimize organizational risk.
