The acronym PFAS encompasses thousands of different fluorinated substances with various carbon chain lengths, side groups, and functional groups. But not all PFAS are created equal. In fact, relatively few have been studied with any level of scientific rigor. Nevertheless, state and federal lawmakers continue to propose—and often pass—regulations that target all PFAS as a class. Several industries, organizations, and agencies, including the U.S. Department of Defense and the U.S. Chamber of Commerce, have been vocal in their opposition to such broad class-based bans, performing studies and/or issuing reports detailing how widespread bans on all fluorinated substances would significantly impact critical sectors of the U.S. economy. In this session, we will examine how only a few PFAS, primarily PFOA and PFOS, are driving current regulations, explore the differences between polymeric and non-polymeric PFAS, and discuss how broad class-based bans could impact your business.
