Prior art in IPR proceedings is confined to patents and printed publications. This article discusses the burden of proof when asserting that a publication is prior art, and contrasts the results in two decisions from PTAB (Patent Trial and Appeal Board), one holding that the prior art constituted a printed publication and one holding that it did not.
