Don Wang counsels technology companies in intellectual property litigation matters in district courts and before the U.S. International Trade Commission (USITC), and the Patent Trial and Appeal Board (PTAB). Don has handled patent disputes in a variety of technologies, including cellular communication modules, IoT, semiconductor manufacturing, cloud computing, and remote security devices. Before joining Venable, Don was an IP secondee for a leading global technology company in Mountain View. He also served as a co-chair of the LGBTQ+ employee resource group at his previous firm.

Experience

Representative Matters

  • Developed prior use/prior invention defenses in patent infringement action in Delaware involving remote vehicle security technology; case was resolved following claim construction
  • Drafted petitions and handled expert depositions and prehearing motions in four inter partes review (IPR) proceedings, resulting in final written decisions of unpatentability of all 100+ challenged claims and Rule 36 affirmance of patent owner appeal
  • Developed non-infringement and technical domestic industry/invalidity defenses in a 337 investigation involving four patents directed to 3G/4G LTE standards, resulting in a final determination of no violation
  • Defended against patent claims relating to H.264 video encoding/decoding and smart device GUI technology in a 337 investigation on behalf of the intervenor
  • Defended a start-up against chip-design software provider's claims of breach of end user license agreement and violations of the Digital Millennium Copyright Act
  • Secured remand of the VA's denial of claims on behalf of a Navy veteran's surviving spouse before the U.S. Court of Appeals for Veterans Claims
