Max Wellman is the chair of Venable’s litigation department in Los Angeles. In addition to his entertainment and business litigation practice, Max serves as outside general counsel for talent, studios, agents, managers, production companies, merchandising companies, celebrity-founded consumer brands, artists, entrepreneurs, and content creators. Max builds personal relationships with his clients and takes a proactive role in their businesses by litigating their “bet the company” cases, negotiating their complex corporate transactions, managing their public crises, and helping protect their significant assets. His litigation matters involve defamation, copyright, trademark, trade secrets, right-of-publicity, unfair competition, and other complex commercial and probate disputes.

  • Representing Creative Artists Agency (CAA) in connection with intellectual property and artificial intelligence matters
  • Represented London Alley Entertainment in a sale to VICE Media Group
  • Serves as outside litigation counsel for Entertainment 360 (formerly Management 360)
  • Represented Top Drawer Merch in connection with artist and festival merchandise agreements, and the sale of interest in the company 
  • Representing celebrity comedian Andrew Schulz in connection with defending against defamation claims
  • Representing Katherine Heigl and her foundation in connection with an ongoing publicized defamation claim
  • Defended an artist and producer in a copyright infringement case

Technology and Business

  • Representing Moose Toys in connection with general corporate and intellectual property matters
  • Represents Mammoth Distribution in connection with its trademark portfolio, licensing deals, and acquisitions
  • Represented NexGen Air Conditioning and Heating LLC in its acquisition by the private-equity-backed Wrench Group
  • Represented a celebrity client in connection with the sale of his live-selling fashion business and book deal
  • Obtained a favorable decision, including forfeiture of a disputed URL in a Uniform Domain-Name Dispute Resolution Policy (UDRP) claim for Nahmias fashion brand
  • Obtained judgments of more than $18 million in a fraud and conversion claim on behalf of a group of real estate investors 
  • Successfully defended a technology start-up in a heavily litigated trade secret dispute filed by a well-known private company 
  • Successfully prosecuted a shareholder derivative action on behalf of three former owners of a wine company in Paso Robles  
  • Successfully served as lead trial counsel in a heavily disputed quiet title action culminating in a multi-day bench trial that resulted in a favorable pre-verdict settlement after presentation of evidence  
  • Represented influencer-backed beverage brand Seoul Juice in connection with a sale of Food Story Brands
