Protecting brands abroad has become increasingly important for nonprofits. Foreign countries represent a source of new members, donors, supporters, and customers, as well as opportunities for other expansion. Yet trademark law (the law of branding) operates on a country-by-country basis. This creates pitfalls for nonprofits: from not knowing what rights the nonprofit owns in key countries; to not understanding the different trademark rules that apply in those countries; to failing to register the right brands in the right countries and for the right goods/services; to failing to police chapters, affiliates, members, vendors, and others who improperly register the nonprofit’s brands.
