A story in the June 7, 2009 edition of the Baltimore Sun discussed the practical and legal options available to home buyers when builders fail to deliver as promised.
In the story, Venable partner John Prisbe discussed the legal options buyers may be able to pursue if other efforts to resolve the dispute fail. He advised buyers to check their contract, which can call for binding arbitration or other forms of alternative resolution and prohibit a buyer from suing the builder.
"[the contract] could dictate where you're going to bring your claim," said Prisbe, who has represented buyers and builders. He also advised buyers to weigh legal costs against their chances of recovering damages and to remember that the plaintiff has the burden of proof.
