John Cooney and co-counsel beat back federal deep water drilling moratorium in Fifth Circuit

Venable partner John Cooney and litigation counsel from New Orleans-based Jones Walker on Thursday delivered another victory for a consortium of drilling services companies led by Hornbeck Offshore Services. Cooney’s role was mentioned in coverage by American Lawyer, Law360 and numerous other media outlets.

On Thursday, July 9, Cooney and Carl Rosenblum of Jones Walker once again stymied the Obama administration's efforts to enforce a six-month ban on deep water drilling operations, when the Fifth Circuit ruled 2-1 that the Interior Department had not proven that the U.S. would be irreparably harmed if the moratorium was not immediately enforced.

Justices Eugene Davis and Jerry Smith also wrote that the government "has made no showing that there is any likelihood that drilling activities will be resumed pending appeal."

The court also set an expedited schedule for the case. Parties' briefs are due over the next six weeks and oral arguments are scheduled for August 30.
