Venable partner Len Goodman was quoted in an August 13 Law360 story about so-called LEEDigation. According to the article, an uptick in green construction may lead to a rise in litigation - including challenges to the performance ratings of buildings, as well as conflicts between owners, contractors and architects when the certification goes awry.
"The floodgates have not opened, fortunately, but we are still very early in LEED's lifecycle," said Leonard S. Goodman, a Leadership in Energy and Environmental Design accredited professional who practices in construction, transactions and litigation. "I would not be surprised to see LEED cases involving the failure to secure certification in the future."
