Goodman Leonard

Len Goodman is an experienced construction attorney who focuses on construction transactions, risk management, and dispute resolution. Len represents clients in all aspects of property development and has extensive experience developing and implementing strategies to manage and minimize construction-related risks and claims on new construction and major renovation projects from a contractual, insurance, bond, and operations perspective. He has helped guide the completion of hotel, condominium, commercial building, transportation, and energy projects valued at more than $2 billion.

Len draws upon his three decades of experience to achieve the most favorable results in drafting and negotiating design, construction, and other agreements for his clients, and representing them in development related disputes. He has worked with all of the major professional design and engineering organizations, including the American Institute of Architects (AIA), the Associated General Contractors (AGC), the Design-Build Institute of America (DBIA) the Engineers Joint Contracts Documents Committee (EJCDC), and the International Federation of Consulting Engineers (FIDIC).

In 2009, Len earned certification as a LEED®-Accredited Professional from the United States Green Building Council—one of less than 200 legal professionals at the time to have earned this certification. He is adept at negotiating "green" provisions into his clients' design and construction contracts.

Len has defended and prosecuted numerous complex commercial contract, construction, and product defect matters. As an example, For five years, Len led a nationwide team of attorneys in prosecuting a multi-state construction defect and product defect litigation on behalf of a prominent national hotel chain with 250 properties at issue. As lead trial attorney, Len won a significant jury verdict in Massachusetts state court in the first of these cases to go to trial. During a second trial in Federal Court in Pennsylvania, Len's client achieved an extremely favorable, eight-figure global settlement of all pending cases.


Representative Matters

In the past three years, Len has negotiated and drafted the transaction documents related to the following Projects:

  • "Cost plus fee" with guaranteed maximum price contract ("GMP") to construct 319 unit multifamily housing project in Las Colinas, TX ($43MM)
  • Design-build GMP (and related services) contract to construct +/-207,500 SF industrial warehouse and related site work in Philadelphia, PA ($15MM)
  • Lump sum contract to construct 84 unit, 73,000 SF assisted living (+retail) project in Fredericksburg, TX ($15MM)
  • Lump sum design-build contract to construct eight story, 214 guestroom hotel in Atlanta, GA ($40MM)
  • Architectural, engineering and GMP contracts to design and construct 3 story, 110,000 SF, high performance computing data center in Atlanta, GA ($40MM)
  • GMP contract to construct 100,000 SF museum in Washington, DC ($43MM)
  • GMP contract to construct 223 room hotel, restaurant, and rooftop venue in Chicago, IL ($92MM)
  • Architectural, engineering GMP and related contracts to renovate and repurpose existing, historic resort property including ground-up construction of new hotel-condominium and parking structures, and renovation of existing guestrooms, restaurants, and public spaces in San Diego, CA ($100MM)
  • Architectural and engineering services agreement to design +/-$70MM renovation of existing office tower in Los Angeles, CA including new exterior facades. new MEP systems, and associated shell and core interior design renovations
  • Architectural, engineering, GMP and related contracts to renovate existing 450 room/cottage resort property in anticipation of development and sale of high-end luxury condominium/hotel beach villas including guest arrival, food and beverage, guestrooms and amenity spaces in Oahu, Hawaii ($60MM)
  • GMP contract to renovate existing, historic 10 story, 112,000 SF hotel (180 guestrooms) including addition of new rooftop amenity in Washington, DC ($30MM)
  • Lump sum design-build contract to convert existing, 32,000 sf building into a new food production facility in Georgia ($25MM)
  • Architectural services agreement to design +/-$5MM renovation of exterior and interior spaces of existing, historic office building in Seattle, WA including lobby, retail, restaurant, and elevator
  • Lump sum contract to expand existing food production plant by constructing new building and renovating existing building including procurement of processing equipment located in South Carolina ($20MM)
