Venable partner Bill Coston was quoted in a May 13, 2011 Law360 article regarding the effect of the Department of Justice/Microsoft deal nine years ago.
Coston stated, "The Microsoft litigation demonstrated the trouble traditional antitrust law enforcement has had in trying to apply a static antitrust analysis to a dynamic market." He further explained, "It’s very difficult for traditional antitrust enforcement, which can sometimes grind slowly, to fix what are immediate problems in a technology economy. The case might argue for finding a way for more rapid deployment of antitrust analysis, fixing what you can quickly and letting the market try to fix the rest.”
