In an October 3, 2011 article, Law360 highlighted Venable’s latest win on behalf of Merck. This past Monday, a federal jury in New York sided with Merck for the fourth time in a bellwether case in multidistrict litigation that alleged Fosamax causes jaw deterioration.
The verdict in favor of Merck came after a judge dismissed all but one of the plaintiff’s claims. Law360 noted the importance of the victory saying it “will be used to help guide litigation in hundreds of others, all consolidated in the Southern District of New York, that make similar claims against Merck.”
