Venable partner Ari Rothman was quoted in an August 12, 2014 Daily Journal article on an increase in Telephone Consumer Protection Act (TCPA) suits. TCPA suits, with damages up to $1,500 per call, have spiked in recent years growing from just 14 cases in 2008 to over 1,800 last year. The increased number of suits is a result of plaintiffs using the TCPA to combat messages or calls from companies directly marketing to consumers’ phones.
“The consuming public is using their cell phones more frequently than their laptops or desktops,” said Rothman. “As a result, companies - from brick and mortar stores to startup technology companies - are wanting to get consumers' attention through mobile devices.”
