Venable partner Randy Miller was quoted in a March 17, 2015 National Law Journal article on a suit between two leading vacuum cleaner manufacturers over misleading advertising. In dueling lawsuits, both Dyson Inc. and Euro-Pro Operating LLC claim the other made misleading statements in advertising to outdo its competitor.
"There was a lot of publicity over the fact that Shark was essentially kicking Dyson's butt in the marketplace," said Miller who represents Euro-Pro. "Dyson's response was to light up litigation." A four-day evidentiary hearing in January largely focused on testing methods between the two manufacturers. "There was a great moment where [Euro-Pro's] chief executive officer ran the vacuum cleaner on test carpets in court," Miller added.
