On August 18, 2021, Law360 reported on a decision by the Court of Appeals for the Federal Circuit in SmileDirectClub v. Candid Care Co., affirming a decision made late last year in which the District Court for the District of Delaware granted Venable client Candid Care’s motion to dismiss, invalidating a patent owned by teleorthodontics competitor SmileDirectClub as being directed to an abstract idea. The article quotes Candid’s appellate brief for arguing “While some patent eligibility cases may present close calls, this one demonstrably does not” and quotes Venable partner Mike Sandonato as saying that the “Delaware court’s opinion invalidating SmileDirectClub’s patent was thorough and well-reasoned, and we are pleased that the Federal Circuit has affirmed it.”
