Ed Haughey handles the full spectrum of intellectual property law, with a particular emphasis on patent and trademark litigation. Ed’s experience encompasses a broad range of technologies involving the mechanical, electrical, computer, and pharmaceutical industries. He has represented business and industry leaders in litigations in U.S. district and appellate courts, and in Section 337 investigations before the U.S. International Trade Commission (ITC). In addition to his litigation practice, Ed regularly counsels clients on patent and trademark protection, clearance, licensing, and enforcement strategies.

Representative Matters

  • Represented Canon in multiple ITC investigations and parallel district court actions involving toner cartridges and toner bottles, obtaining four general exclusion orders
  • Defended Candid Care in a patent infringement action brought by SmileDirectClub involving teleorthodontics. Won dismissal of § 101 grounds; affirmed on appeal (D. Del. and Fed. Cir.)
  • Represented Canon in a patent infringement action against Color Imaging and General Plastic involving toner bottles for copy machines. Following a 10-day trial, the jury returned a verdict for Canon on all issues and awarded the full measure of damages sought, which the court subsequently enhanced, and awarded Canon a permanent injunction (N.D. Ga.)
  • Represented Canon in a series of IPRs filed by General Plastic involving toner bottles, which resulted in the precedential General Plastic v. Canon decision (P.T.A.B.)
  • Defended MasterCraft Boat Company in two patent infringement actions brought by Malibu Boats involving wake surf systems (E.D. Tenn.)
  • Represented MasterCraft Boat Company in a patent licensing dispute (AAA Arbitration)
  • Defended Canon against a patent infringement action brought by Walker Digital involving digital cameras (D. Del.)
  • Defended Canon against a patent infringement action brought by Lodsys involving inkjet printers and software (E.D. Tex.)
  • Defended Canon against a patent infringement action brought by Norman IP Holdings involving interrupt enabling and clock generator circuitry (E.D. Tex.)
  • Represented Novartis in patent infringement actions against Teva, Roxane, and Macleods involving methods of treatment with the antiviral compound Famvir® (D.N.J. and D.D.C.)
  • Represented Munters against Novelaire Technologies in a patent infringement action involving methods and systems for conditioning air (N.D. Ga.)
  • Represented Canon in a patent infringement action against GCC and Q-Imaging involving toner cartridges for laser printers (S.D.N.Y. and Fed. Cir.)
  • Represented Mutual of Omaha in multiple trademark infringement and unfair competition actions (D. Neb.)
  • Represented Rohde & Schwarz in a patent interference involving the real-time testing of digital television antenna transmitting systems (B.P.A.I.)
  • Defended Canon against a patent infringement action brought by Compression Labs involving digital image compression (E.D. Tex. and N.D. Cal.)
  • Represented Donnelly in a patent infringement action against Johnson Controls involving digital compasses and electrochromic mirrors for vehicles (W.D. Mich.)
