On May 16, 2023, Ari Markenson was featured on American Health Law Associations’ Speaking of Health podcast, where he discussed the two major government sources of funding for healthcare providers during the COVID-19 pandemic, the provider concerns regarding fund disbursement, fund spending and the ramifications of those decisions, and how providers should respond to the government’s enforcement activity related to the use of those funds.
Commenting on how providers should respond to questions regarding fund use, Markenson explained, “There's a difference in whether [the government] is looking at this issue civilly or criminally or are just doing research right now. However, providers should rely on something other than their own understanding of that. So, in deciding whether you answer questions and give out information, speak to your counsel, understand what the approach should be with respect to whoever you're being asked questions from and how you're being asked the questions.”
