On September 28, 2023, the U.S. Government Accountability Office (GAO) affirmed the $21 million Defense Information Systems Agency (DISA) contract awarded to Venable client Agile-Bot II LLC after determining that a protesting competitor had failed to comply with a requirement of the agency’s solicitation. Venable represented Agile-Bot II LLC’s interests as an intervenor in the bid protest and successfully supported DISA in seeking the GAO’s dismissal of speculative protest grounds related to Agile-Bot II’s proposal, as well as the GAO’s denial of the remaining portions of the protest.
The disputed contract sought support for how DISA verified the identities of people accessing sensitive information for the Joint Service Provider, one of DISA's field operating agencies. Six entities total had bid on the deal, with DISA ultimately awarding it to Agile-Bot II LLC.
