Smartwatch wristbands, adhesive bandages, tampons and juice containers—what do they all have in common? In a growing trend, plaintiffs attorneys allege the products contain toxic forever chemicals and that manufacturers misled consumers about it.
While multibillion-dollar settlements in litigation over the use of firefighting foam that contained per- and polyfluoroalkyl substances have captured headlines over the past couple of years, consumer products are increasingly coming into plaintiffs attorneys' crosshairs, said Caitlin Blanche, a partner at Venable LLP who specializes in consumer class actions and product focused litigation.
"We've been watching this litigation and working in this space now for a few years, and we're starting to see the growth and adaptation of the plaintiffs bar in this area," Blanche said. "We're seeing an expansion and a shift over to broader fitness and lifestyle tech and products that make general lifestyle health or longevity representations."
