Bryan Weintrop practices complex commercial litigation for companies in the advertising, food and beverage, entertainment, car rental, real estate, and crypto-currency industries. Bryan also has experience representing individuals in trust and estate litigation. Bryan regularly represents clients in state and federal courts in a wide range of matters, including class actions, general business disputes, false advertising disputes, complex real estate transaction disputes, probate disputes, defamation defense, unfair competition defense, commercial unlawful detainer, and automotive repair regulatory defense. Bryan also routinely briefs on complex issues before the California Court of Appeal and Ninth Circuit court of appeals.

Experience

Representative Matters

  • Successfully defended multiple dietary supplement manufacturers against claims alleging Lanham Act false advertising, including through appeal to the Ninth Circuit
  • Obtained dismissal of all claims and award of attorneys’ fees under the California Anti-SLAPP statute in a case brought against a car rental service client for defamation and fraud
  • Obtained dismissal of numerous class action claims alleging false advertising brought against food and dietary supplement manufacturers
  • Defended against and obtained dismissal of class claims relating to non-functional slack fill brought against food and dietary supplement manufacturers
  • Obtained dismissal of class claims alleging violations of the Telephone Consumer Protection Act (TCPA) on behalf of multiple clients
  • Defended client accused of elder abuse in a complex trust and estate proceeding
  • Defending an NBA player in connection with complex civil litigation pertaining to domestic disputes
  • Obtained and enforced a $15 million judgment on behalf of an aspiring singer and model who brought claims against a Grammy Award–winning music producer
  • Routinely brings and defends against claims relating to indemnification and defense obligations under commercial contracts
  • Defended $50 million specific performance action regarding a complex commercial real estate transaction, which proceeded through a 15-day bench trial, resulting in a defense victory
  • Obtained a six-figure judgment in a commercial lease dispute that proceeded through a bench trial
  • Drafted multiple briefs before the California Court of Appeal on complex issues, including the California Anti-SLAPP statute, California agency law, and the enforceability of default judgments
  • Drafted multiple complaints regarding complex commercial disputes, including breach of contract, fraud, breach of fiduciary duty, and interference claims
  • Obtained a victory through summary judgment on behalf of a pro bono client, the mother of a special needs child accused by a school district of parental liability in an action related to sexual abuse on school property
  • Negotiated multiple settlement agreements in numerous representative matters, including under the TCPA and Fair Credit Reporting Act, and in breach of warranty disputes
  • Regularly enforces arbitration provisions on behalf of several clients
