Issues involving charitable gifts have been the subject of much recent scrutiny by the law and the media. Independent schools that receive charitable contributions need to be familiar with the legal issues surrounding the acceptance, retention, and disposition of such gifts. Organizations should be knowledgeable about the requirements and burdens surrounding the receipt of different classes of assets, including real estate and closely held stock, as well as issues involving compliance with, and deviation from, donor-imposed restrictions on the use of gifted property. In addition, organizations should understand the different types of vehicles available to donors to make charitable gifts and the various restrictions placed on the donors in making such gifts. This includes the income tax charitable contribution limitations, the estate and gift tax rules, and the use of different estate planning vehicles, such as charitable remainder trusts, charitable lead trusts, and charitable gift annuities. This session helps position your school, including professionals and lay volunteers, to effectively communicate with current and prospective donors and to create an environment that is conducive to securing meaningful charitable commitments for the growth and development of your institution.
