This month’s presentation will provide an overview of how your nonprofit’s revenue-generating activities could give rise to unrelated business income tax (UBIT) obligations, and how to minimize that risk. It will focus on how revenue generated by a nonprofit becomes taxable income and, even more importantly, when tax can be avoided by careful compliance with the Internal Revenue Code. These issues arise for nonprofit, tax-exempt organizations in many contexts, and the presentation will cover corporate sponsorships, advertising, licensing arrangements, endorsements and royalties, and cause-related marketing, among other subjects. The details in this area are important, and all nonprofits (and their advisers) should understand the critical distinctions that separate taxable income from tax-free revenue. The panel will cover the major UBIT sources and common pitfalls, and will share guidance on how to maximize tax-free revenue, with practical tips to help nonprofits structure and document deals to optimize their economic gain.
