It is estimated that roughly 55 million adults in the US are either “unbanked” (no bank account), or “underbanked” (have a bank account, but no access to credit). Thanks to a volume of new fintech companies aimed at these groups, a full range of banking products from deposit accounts to credit cards are now within reach. This session will provide an overview of the state and federal financial services regulatory landscape and the challenges it poses to service providers. Additionally, we will explore technological innovations that have facilitated financial inclusion, including the use of alternative data sources and artificial intelligence in underwriting cryptocurrencies and fraud detection and prevention software.

In a July 2020 decision, the EU Court of Justice dealt a blow to international data transfers that invalidated the US Privacy Shield program. The decision also placed upon European data exporters an obligation to ensure adequacy when transferring data under other permissible methods. Our panel will discuss the current state of recommendations and guidance, in the wake of the 2020 decision, the effects of the European Data Protection Board’s comments, and the revised standard clauses on cross-border transfers.
