Privacy continues to be an area of rapid legal development. California, Colorado, Connecticut, Utah, and Virginia have enacted comprehensive consumer privacy laws that all take effect in 2023. There are multiple rulemakings under way that are associated with these laws, even as additional state legislatures, Congress, and the Federal Trade Commission actively consider further privacy legislation and rulemaking. Enforcement trends are also evolving, with new authorities taking the lead federally and in California.
