CPSC Chairman Alexander Hoehn-Saric stated last year that “failure to report in a timely fashion will result in an investigation, and CPSC will pursue significant civil and potentially criminal penalties,” and this has proved to be no exaggeration. Manufacturers, importers, and retailers in the consumer products industry must understand their compliance obligations under product safety laws and standards, whether it’s the duty to report a potential product defect; design and testing requirements for specific product categories like children’s toys or lithium-ion batteries; or federal and state laws regulating the presence of chemicals in products, “environmental” or recycling claims, and warranties.
