Sarah and the panel are set to discuss the Amgen v. Sanofi case, where the Supreme Court weighed in on the enablement requirement of 35 U.S.C. §112. While some experts disagree on the extent to which the decision represents a change in law or a reaffirmance of existing standards, §112 law has continued to develop as lower courts grapple with enablement defenses raised by defendants, particularly as they relate to broadly drafted functional claims in the life sciences industry. This panel will discuss the current state of written description and enablement under §112, as well as best practices and considerations for meeting these requirements.
