Sarah Brooks

Sarah Brooks is a first-chair litigator who represents clients in trademark and patent disputes in federal courts and before the Trademark Trial and Appeal Board (TTAB) and Patent Trial and Appeal Board (PTAB). Sarah provides brand protection services to clients ranging from consumer products companies, including toy and sporting goods manufacturers, to medical device and biotech innovators. She helps clients navigate the full legal process, from pre-litigation to trial and appeal. Focused on her clients' goals at the onset of a matter, Sarah strategizes on the best option to achieve success, be it through mediation, settlement, or going to trial.

With a background in science, Sarah is adept at understanding the latest technologies. She draws from this education and experience to help clients in a range of technology sectors, including wireless telecommunications, semiconductors, computer sciences, and streaming services, to protect their innovations and brands.

Sarah is also highly involved in pro bono matters, with a focus on helping children in guardianship and immigration matters. She previously served as hiring partner for Venable's Los Angeles office for four years.

Representative Matters

  • Secured a preliminary injunction victory in a trademark dispute on behalf of client 2ONE Labs and PPM against Imperial Tobacco, the third-largest tobacco company in the world
  • On behalf of the Marshall Tucker Band, successfully canceled trademarks filed by the band’s former manager, who claimed ownership of the group’s name and logo, in order to secure trademarks used in merchandising and licensing transactions
  • Represented a Michelin-starred restaurant in a trademark infringement lawsuit alleging willful infringement by an e-commerce company, resulting in a favorable settlement for the plaintiff
  • Represented a patent owner in nine IPRs, and succeeded in five being non-instituted. In the four IPRs that were instituted, claims survived in three

Pro Bono

  • In conjunction with the Civil Rights Corps and the American Civil Liberties Union (ACLU), represented the plaintiffs in Singleton et al. v. Cannizzaro, achieving a historic settlement with the Orleans Parish District Attorney's Office (OPDA), bringing an end to the OPDA's years-long use of fake subpoenas and intimidation to illegally coerce and jail victims and witnesses
