Arbitration: How to Maximize Its Pros and Minimize Its Cons

Most of our corporate clients continue to favor arbitration when appropriate. When functioning as intended, arbitration can offer a faster, more cost-effective, and confidential alternative to litigation, while allowing disputes to be decided by neutrals with relevant subject-matter expertise rather than a jury. That said, these advantages are not universal. In recent years, arbitration has at times become as costly and time-consuming as court litigation. Moreover, there is virtually no appellate review whatsoever of arbitration awards. Partners Brian Koosed and John Worden walk through the factors to consider determining the optimal forum for potential disputes.
