Ad Agency Contracts: Key Negotiating Points, Leverage, and Getting to Win-Win

Most lawyers know how to negotiate a contract. However, advertising industry agency agreements come in all shapes, styles, and flavors, and have their own unique issues. "How hard could it be?" you may think. Well, whether you are negotiating an agency agreement for creative, media buying, or influencers, or for an agency to handle administration of sweepstakes and promotions, each area has particularized concerns of which the lawyer must be aware. And remember, difficult contract negotiations may poison the working relationship between the agency and the company at the outset, so it makes sense for both sides to understand the issues involved and reach an agreement where each side is happy to move forward to do the actual work. This session will provide an overview of key issues involved in negotiating ad industry agreements.
