More than 30 years after DSHEA was enacted, the dietary supplement marketplace—and the challenges facing responsible industry—have changed dramatically. Recent uncertainty over something as fundamental as placement of the DSHEA disclaimer illustrates the consequences when longstanding regulatory interpretations are not reflected in clear, durable rules. Drawing on CRN’s recent Citizen Petition as one example, Venable partner Todd Harrison’s presentation will make the case for moving beyond incremental fixes toward “DSHEA 10.0”: a modern framework that provides greater regulatory certainty, reflects today’s science and marketplace, strengthens FDA’s ability to oversee the industry, and creates clear rules that apply to regulators and industry alike.
