John Cooney has published an article Multi-Jurisdictional and Successive Prosecution of Environmental Crimes in the Journal of Criminal Law and Criminology, sponsored by the Northwestern University School of Law.  The article analyzes a feature of environmental criminal law that is not found in other areas of federal enforcement – that the Department of Justice will prosecute a corporate defendant in multiple jurisdictions, and in some cases on more than one occasion, for what in essence is the same criminal conduct.
