D.C. Circuit Panel Dissects TCPA Terms in Order Appeal

Earlier this month, a three-judge panel of the U.S. Court of Appeals for the D.C. Circuit heard oral arguments in a consolidated appeal filed by various telemarketing industry members challenging parts of the Federal Communications Commission's (FCC) July 2015 Telephone Consumer Protection Act (TCPA) Declaratory Ruling and Order. In his recap of the hearing, Venable's Daniel S. Blynn writes that the judges were difficult to read as they questioned the petitioners and respondents. The inherent ambiguity and uncertainty in the language will likely continue to trouble businesses, marketers, and attorneys alike.
