Effective July 1, a recently enacted Florida law, S.B. 700, broadly prohibits those involved with charitable solicitations or sales promotions from receiving or soliciting funds from individuals and entities associated with certain foreign countries.
Enacted on May 15, the legislation establishes a registry that will feature only certain nonprofits that certify that they are not influenced by and do not solicit or receive support from a broad group of foreign sources of concern. Florida's law is the first in the nation to regulate foreign influence through state charitable solicitation jurisdiction.
It follows a growing trend of states considering ways to regulate foreign influence within their borders, increasing focus on foreign operations of U.S. nonprofits and developments in enforcement priorities for the federal Foreign Agents Registration Act and Foreign Corrupt Practices Act.
