Brian Healy focuses on product liability and other complex civil litigation, with considerable experience representing clients in high-stakes cases in federal and state courts nationwide. Brian regularly defends manufacturers of vaccines and other prescription medications in single-plaintiff actions, multidistrict litigation, and statewide coordinated proceedings. Across these matters, he often addresses highly technical factual, scientific, and legal issues to drive favorable client outcomes. Those skills have evolved from Brian’s work with experts and data on key issues of immunology, epidemiology, toxicology and other scientific disciplines, as well as work with complex legal principles, such as preemption.

Brian's experience spans the life cycle of litigation, from pre-suit negotiations through assistance at trial. At the outset, Brian helps develop litigation-wide strategies to ensure the best possible outcomes. He then manages key aspects of executing those winning strategies, including propounding and responding to written discovery, developing expert witnesses, taking and defending critical fact and expert witness depositions, and advocating for clients at hearings. He has also drafted several dispositive motions, including motions to exclude experts under Federal Rule of Evidence 702.

Brian's practice has yielded significant results for clients. Previously, as part of an insurance coverage dispute, Brian’s leadership netted up to $15 million in defense costs benefitting a national meat and poultry processor facing sprawling antitrust claims. He took the lead on drafting the summary judgment motion that resulted in the advancement of those costs. Brian also recently assisted in Venable’s successful defense of a home exercise equipment manufacturer in a personal-injury action, as well as the related insurance coverage litigation.

Representative Matters

  • Represented manufacturer of prescription medication in several federal courts, as well as in state coordinated proceedings, in litigation involving allegations a medication caused neuropsychiatric injuries. Assisted in developing and implementing overall defense strategy. Led fact discovery in several lawsuits, including taking plaintiff, prescriber, and treating physician depositions. Drafted several successful dispositive motions, including motions to dismiss, motions to exclude expert testimony under Federal Rule of Evidence 702, and motions for summary judgment. Motions frequently addressed complex legal issues, including personal jurisdiction, choice of law, statute of limitations, innovator liability, preemption, and proximate causation
  • Represented a vaccine manufacturer in state court lawsuits and federal multidistrict litigation involving allegations that a vaccine causes autoimmune diseases. Assisted in developing and implementing overall defense strategy. Managed written discovery, identified and developed expert witnesses, took fact and expert witness depositions, prepared company witnesses for depositions, and defended expert witnesses at depositions
  • Represented a national meat and poultry processor in an insurance dispute regarding coverage for underlying antitrust claims. Managed discovery and drafted the winning summary judgment motion that resulted in an order obligating the insurer to advance up to $15 million in defense costs
  • Represented a vaccine manufacturer multidistrict litigation involving allegations that an adult vaccine failed to protect against the disease it was designed to prevent and also caused various other injuries. Managed case-specific written discovery and took fact witness depositions
  • Assisted in Venable’s representation of a manufacturer of proton-pump inhibitors in multidistrict litigation involving allegations its product caused kidney injuries. Assisted in case-specific discovery, including taking Plaintiff, prescriber, and treating physician depositions
  • Assisted in Venable’s successful defense of a home exercise equipment manufacturer in a state court products liability lawsuit involving allegations of serious personal injury, as well as the related coverage action against the manufacturer’s insurer in federal court. Helped develop overall litigation strategy and managed discovery and filings in both actions
