Katherine Milea focuses her practice on intellectual property and patent litigation in the life sciences and pharmaceutical arts. Registered to practice before the U.S. Patent and Trademark Office, Katherine has represented clients in trials in federal district courts, contested proceedings at the Patent Trial and Appeal Board (PTAB) including post-grant reviews (PGRs) and inter partes reviews (IPRs), appellate cases at the U.S. Court of Appeals for the Federal Circuit, and Section 337 investigations before the International Trade Commission (ITC).

In addition to litigation, Katherine provides patent portfolio counseling and guidance on transactional matters. She has performed due diligence for mergers and acquisitions, including ownership, freedom to operate, and patentability analyses. Her experience covers a broad range of areas and technologies, including cancer, rare genetic disorders, chronic pain, urinary symptoms, nutraceuticals, hemophilia, neutropenia, immunotherapies, and mRNA vaccines, among others.

  • Represented Sanofi in multiple district court litigations, Federal Circuit appeals, and an IPR against several generic companies related to Jevtana®, a chemotherapy for use in the treatment of advanced prostate cancer
  • Represented Genzyme and the Regents of the University of Michigan in a Hatch-Waxman district court litigation against several generic companies related to Cerdelga®, an oral treatment for Gaucher disease
  • Represented Bioverativ and Genzyme in an ITC proceeding, and a district court litigation related to Bioverativ’s patents on its monomer-dimer hybrid immunoconjugate platform technology
  • Represented Sanofi in its acquisition of the clinical-stage mRNA therapeutics company Translate Bio
  • Represented Grunenthal and Abiogen as petitioners in several post-grant reviews (PGRs) at the Patent Trial and Appeal Board and in related Federal Circuit appeals on patents related to the use of bisphosphonates for chronic pain
