Los Angeles, CA (Sept. 2, 2026) — Venable LLP secured a complete victory on behalf of Greenvision, LLC in its dispute with Temescal Wellness of Maryland, LLC, doing business as Evermore Cannabis Company, following the conclusion of arbitration. Most recently, the arbitrator issued a final arbitration award, wherein he found Greenvision to be the prevailing party, and awarded the company more than $1.3 million in attorney's fees and costs. The Venable team is now petitioning the California Superior Court to confirm the final award via a binding judgment, which will bring the matter to a successful conclusion for the client.
The dispute arose from a series of cannabis industry financing transactions and advisory agreements under which Greenvision introduced financing and business opportunities to Evermore. Greenvision alleged that Evermore failed to disclose material transactions and business relationships while improperly withholding transaction fees owed under the parties' agreements. Evermore asserted cross-claims alleging that Greenvision was liable for breach of fiduciary duty and the implied covenant of good faith and fair dealing in connection with the capital advisory services Greenvision provided to Evermore.
In a 62-page final arbitration award, the arbitrator ruled in Greenvision's favor on claims for breach of contract, breach of the implied covenant of good faith and fair dealing, fraud (misrepresentation), and declaratory relief. The arbitrator rejected all claims asserted by Evermore and found Greenvision to be the prevailing party, thereby awarding more than $612,000 in damages and interest along with more than $1.36 million in attorney’s fees and costs.
Following the final arbitration award, Venable filed a petition to confirm the award in California Superior Court. The Venable team and the client eagerly await the court’s confirmation, which will allow them to immediately begin collection efforts and proceedings.
