Sweepstakes and prize promotions have evolved considerably since George Washington used a lottery to help finance his Revolutionary Army, though some of the precedent in the area seems like it is nearly that old. Structuring a legally compliant digital promotion in this highly regulated space has become particularly tricky, moreover, given the ever-faster pace at which the technology is developing, and the government’s close scrutiny of issues like dark patterns and disclosures, privacy, and other matters related to promoting prize giveaways.
