Sweepstakes and prize promotions have evolved considerably since George Washington used a lottery to help finance his Revolutionary Army, though some of the precedent in the area seems like it is nearly that old. Structuring a legally compliant digital promotion in this highly regulated space has become particularly tricky, moreover, given the ever-faster pace at which the technology is developing, and the government’s close scrutiny of issues like dark patterns and disclosures, privacy, and other matters related to promoting prize giveaways. In this program, Melissa and Mark will talk about what’s new in digital sweepstakes, contests, and other types of giveaways, including the latest regulatory and caselaw updates, and provide a framework in which to think about prize promotion concepts.
