Working with Influencers: Legal Essentials for Nonprofits

Social media influencers and content creators can be powerful allies for nonprofits seeking to expand reach, build trust, increase their fundraising efficacy, and mobilize supporters. But working with them comes with legal and regulatory considerations that organizations can’t afford to overlook. To follow the guidelines set forth in the Federal Trade Commission's Endorsement Guides, meet disclosure requirements, act in accordance with intellectual property ownership, and achieve brand safety and mission alignment, influencer relationships require careful planning, well-drafted contracts, and appropriate oversight. Understanding how to structure agreements, manage compliance risks, and protect a nonprofit’s reputation keeps influencer partnerships effective, ethical, and legally sound. This session highlights what nonprofits need to know before engaging influencers, so they can leverage digital advocacy with confidence, including when lobbying or campaign finance rules may come into play.
