As political advertising accelerates ahead of the midterm elections, advertisers, agencies, platforms, publishers, influencers, and other businesses face an increasingly complicated threshold question: When does advertising become “political advertising,” and what additional legal obligations attach once it does?
This webinar will provide a practical framework for making that determination and complying with the unique rules applicable to political communications. The speakers will discuss federal and state political advertising laws; disclosure, disclaimer, reporting, and recordkeeping obligations; emerging state restrictions on the use of artificial intelligence and synthetic media in political advertising; the growing use of paid influencers and creators; political email and text message campaigns; and the different responsibilities imposed on advertisers, campaigns, agencies, publishers, and platforms. Attendees will learn how to identify political advertising issues early and develop a compliance process that accounts for the message, speaker, medium, geography, timing, technology, and parties involved.
