This article discusses a proposed amendment to the Economic Espionage Act (“EEA”) that would have created a private federal cause of action for trade secret misappropriation and compares it to the current state law system for protecting trade secrets. This article further discusses whether an amended EEA would have overcome inconsistencies inherent in the state law system.
