Breathalyzer App's Claims Blew It

Smartphone apps and accessories make all kinds of claims, write Venable attorneys Randy Shaheen and Chris Boone in a recent blog post. However, the FTC's settlement with the marketer of an app-supported breathalyzer device shows that claims for such items must be more than a lot of hot air, and that the FTC maintains broad authority to pursue enforcement against advertising practices it believes are unfair.
