In 2017, a number of courts wrangles with the interpretation and fallout from Escobar, which in turn is making for an interesting 2018. In addition, several memoranda have been issued by the Department of Justice that will significantly alter the False Claims Act landscape for years to come. The authors of this article review the legal issues and note that recipients of federal funds should take stock of such developments in order to be prepared for the road ahead.
