Beth Ann Lennon advises clients on all areas of labor and employment law. Whether guiding employers through the complex patchwork of employment laws or defending them in trial, Beth Ann takes a forward-thinking and pragmatic approach to helping employers minimize their legal risks and achieve their business goals. She manages legal needs big and small, regularly drafting policies and contracts and providing guidance and representation in agency actions and litigation across the United States. She is regularly involved in employment litigation involving complex legal questions, such as immunity, evidentiary issues, and legal questions for which there is no precedent.

When appropriate, Beth Ann has successfully obtained early and cost-effective dismissals for her clients, utilizing alternative dispute resolution tools, including mediation, arbitration, and seeking early resolution through motions practice—always with the client's goals and desires at the forefront of her strategy.

Beth Ann is a passionate advocate for equality and fairness. She is active in numerous organizations promoting causes that include women’s and LBGTQ rights. She co-founded the Young Lawyers Division of the Colorado Lawyers Committee and serves as a co-chair of the Hate Crimes Education Committee. She also regularly writes and presents on trends and current events in state and federal employment law.

Experience

Representative Matters

  • Regularly represents employers in their efforts to protect their rights, through litigation and otherwise, when facing employee misconduct, such as breach of fiduciary duties, violation of restrictive covenants, and misappropriation of company property
  • Served as defense counsel in federal court litigation involving state anti-SLAPP statutes, employee misappropriation of privileged materials, and strategic publicity efforts by a former employee to extort her client
  • Provides comprehensive employment law advice and representation to several employers within the Olympic movement working to support the success of TeamUSA athletes, both on and off the field
  • Served as counsel to an international energy provider in multiple complex and collective wage and hour actions
  • Serves as lead advisor to multiple international and national employers on all aspects of employee relations, including policy and procedure development, workforce management, and response to high-risk workplace situations
  • Advises client involved in executive-level contract negotiations
  • Served as defense counsel in a federal jury trial for claims brought under the Americans with Disabilities Act (ADA)
  • Defended an American symphony orchestra in a National Labor Relations Board (NLRB) trial involving collective bargaining duties and responsibilities
  • Regularly provides on-site, virtual, or hybrid employee legal compliance training on topics such as implementing DEI initiatives, navigating employee health issues, ensuring state-specific anti-harassment obligations are satisfied, conducting effective in-house workplace investigations, and navigating unique employer obligations when working with a unionized workforce
  • Acts as independent investigator of difficult workplace conflicts with potential serious employment law implications, such as when the alleged misconduct involves the CEO of the company or in-house counsel
