Adam Possidente has extensive experience representing clients in all phases of litigation throughout New York state and federal courts, as well as arbitration and mediation proceedings.  Adam addresses a wide range of matters, including complex breach-of-contract disputes, litigation arising from various sophisticated business transactions, mortgage-backed securities litigation, product liability claims, real estate disputes, class actions, and employment litigation.

Representative Matters

  • Representing a business technology solutions company in litigation arising from an asset purchase agreement in New Jersey state court
  • Representing a commercial mortgage-backed securities special servicer in multiple litigations concerning the disposition of a major private residential development
  • Representing a pharmaceutical company in multi-district litigation concerning product liability claims arising from prescription medication 
  • Defended a pharmaceutical company against product liability claims concerning a prescription medication in New York federal court, resulting in the Second Circuit Court of Appeals affirming summary judgment dismissing all claims
  • Represented one of the world’s largest hotel management companies in a dispute with a hotel owner regarding the premature termination of the management company
  • Represented a New York state agency against breach of contract and tort claims brought by a disaster recovery vendor in New York state court
  • Defended a public library against an attempt to stop a development project based on alleged violations of New York environmental review laws, including in a subsequent appeal
  • Defended a prominent New York–based business against a wage-and-hour class action in New York federal court  
  • Defended a national weight-loss company in a wage-and-hour class action in New York state court
  • Represented a major media company in its lawsuit against a global payments company concerning the terms of a prominent prepaid card program in New York state court
  • Defended a college and several of its administrators in a federal action alleging misconduct in the college’s athletics department in New York state and federal courts
  • Defended a former business owner against an FTC motion for emergency injunctive relief, and subsequent civil action, in New York federal court
  • Obtained affirmance from the Second Circuit Court of Appeals of a summary judgment order dismissing a claim that a union had breached the terms of a collective bargaining agreement
