Richard Wells practices at the intersection of patent litigation, prosecution, counseling, and due diligence. Richard is a seasoned litigator with more than two decades of experience practicing intellectual property law. He has extensive experience asserting and defending against patent infringement claims in federal district courts, and before both the International Trade Commission and the Patent Trials and Appeals Board. Richard’s work touches a number of different industries, such as medical device, oilfield, heavy industry, and software.

Richard guides patent due diligence proceedings for clients and takes the lead on valuation assessments regarding their key investment opportunities. He also has vast experience facilitating clearance evaluations of new products entering markets around the globe. This facet of his work includes the skillful preparation of patent-related opinions. Richard regularly and nimbly handles the drafting and negotiation of agreements related to technology, including those related to joint development and licensing,

His practice is informed by his early-career experience of managing a global patent portfolio. In this role, he served as an advisor helping the organization make competitive decisions by exploring an intellectual property angle.

  • Represented an international laptop manufacturer facing allegations of patent infringement in the Eastern District of Texas
  • Represented a leading dermatological device manufacturer combating allegations of patent infringement before the International Trade Commission
  • Represented a streaming media company against patent infringement claims in the District of New Jersey
  • Represented a streaming media company facing patent infringement claims in the Western District of Washington
  • Successfully asserted multiple patents for an oilfield services company in the Southern District of Texas following a two-week trial. Obtained judgment of willful infringement of five patents and a permanent injunction
  • Successfully asserted an inter partes review challenge, resulting in a favorable settlement for a handset manufacturer
  • Successfully defended against patent infringement claims brought against an electronics retailer before the International Trade Commission
  • Represented numerous entities in patent litigation actions in the Eastern and Western Districts of Texas
