DMConfidential.com cites Jonathan Pompan comments on Telemarketing Sales Rule changes

Venable DC attorney Jonathan Pompan was featured in the September 2 issue of DMConfidential.com in an article about the new regulatory and legal threats facing online marketers in a number of industry sectors.

Among the sectors facing regulatory changes is the consumer debt relief industry. The piece illustrated that point with excerpts for an article by Pompan that ran on the site in August. Pompan's article covered recent amendments to the FTC's Telemarketing Sales Rule that focus on the sale of debt relief services. “Under the Final Rule," Pompan wrote in the article, "virtually all debt relief service providers that promote their services through inbound or outbound telephone calls, including calls arising from lead generators and online advertising will be subject to a host of new and existing requirements under the TSR."

He added that the changes, most notably a ban on advance fees before services are provided and a renewed emphasis on companies that provide “substantial assistance,” will drive significant changes to business practices in the debt relief industry. Among those changes, will be to a significant reduction in the number of companies using purchased leads for business development.
